Terms of Service
Last updated 23 October 2026
1. Agreement
These Terms of Service govern your access to and use of the Tonbo platform (the “Service”), operated by Tonbo IO Inc., a Delaware corporation (“Tonbo”, “we”, “us”).
By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to it.
2. Eligibility
You must be at least the age of majority in your jurisdiction (18 years old in the United States), or 18 years old, whichever is higher. By agreeing to these Terms you represent that you meet this requirement, that you are not barred from using the Service under applicable law, and that any information you provide is accurate.
3. The Service
The Service currently comprises:
- Streams — durable streams and the databases built on them;
- User Center — accounts, identity, API keys and billing.
We may add, change or withdraw components. Where a withdrawal materially reduces functionality you are actively using, we will give reasonable notice.
4. Pre-release status
The Service is in a pre-release stage and is provided for evaluation. It carries no availability commitment, no service level agreement, and no data durability guarantee. Interruptions, resets and loss of data are possible, including loss of all data you have stored. Tonbo has no liability whatsoever arising out of or in connection with the pre-release Service. Use it at your own risk.
Do not use the Service as the only copy of anything you cannot afford to lose, for production workloads, or for regulated data.
We may discontinue the pre-release Service at any time and may never make it generally available. We do not commit to preserving data created during the pre-release stage when the Service becomes generally available.
5. Accounts and credentials
Sign-in is through GitHub or Google. You are responsible for the security of the identity provider account you sign in with, and for all activity under your Tonbo account and API keys, including activity by anyone you give access to.
Each account claims a username, a globally unique handle. You may change it once every 90 days. Notify us promptly if you believe your account or an API key has been compromised.
6. Acceptable use
You must not use the Service to:
- violate any law, or infringe the rights of others;
- store or transmit malicious code, or attack any system;
- circumvent quotas, isolation boundaries, or billing;
- resell raw capacity as a substitute for the Service itself; or
- attempt to access another customer’s data or infrastructure.
7. Your content
You retain all rights in the data you store in or send through the Service (“Customer Content”). You grant us only the licence necessary to operate the Service for you: to host, store, transmit, process and display Customer Content, and to make operational backups.
We do not use Customer Content to train models. You are responsible for having the rights necessary to submit your Customer Content, and for its legality.
8. Service providers
The Service operates from AWS us-east-1 (United States) and ap-southeast-1 (Singapore); our Privacy Policy describes which data each region holds. Operating it requires the following providers, each of which processes some portion of your data: Amazon Web Services (compute, databases and object storage), Supabase (authentication), Cloudflare (edge network, DNS and TLS), Stripe (payment processing), and GitHub and Google (sign-in identity providers).
Payment card details are handled by Stripe. We do not receive or store them. How we handle personal information is described in our Privacy Policy.
9. Fees and payment
Paid usage is metered and settled against a credit balance. Streams usage is settled in arrears: it is measured continuously, and a closed period is rated afterwards. Where your balance is exhausted, we may suspend or terminate the affected resources. Fees are stated in U.S. Dollars and are exclusive of taxes, which are your responsibility.
All fees are non-refundable, except as required by law. We may change pricing. Changes take effect 30 days after we notify you, and do not apply to a period already paid for.
10. Suspension
We may suspend access, in whole or in part, where your balance is exhausted; your use threatens the security or integrity of the Service; we are required to by law; or you materially breach these Terms. Where practical, we will give notice first.
11. Termination and deletion
You may close your account at any time from account settings. We may terminate these Terms and your access on notice, or immediately for material breach.
Retention. We retain information for the minimum period necessary to provide the Service, to meet our legal, tax and accounting obligations, to resolve disputes, and to enforce our agreements. In practice that means:
- Customer Content — the payloads in Streams and the databases built on them — is deleted when you close your account. We do not keep it for our own purposes, and we do not archive it. Copies present in operational backups age out on the backup rotation.
- Billing and transaction records are kept for as long as tax, accounting and audit obligations require, and to resolve disputes or collect amounts owed.
- Your username is kept permanently as a tombstone. It is never reissued to anyone else — reissuing a handle would let a later account inherit references to yours.
- A one-way hash of your email address is kept as the audit record that your deletion request was honoured. We do not keep the address itself.
Two things about how deletion executes, which you should understand before relying on it:
- Deletion will not start while an organization still depends on you. If you are the only owner of an organization that has other members, or the only member of more than one organization, the request is refused until you hand those organizations to someone else.
- Completion is not instantaneous. Deletion is carried out by a durable workflow that retries on failure. It begins immediately, but finishing depends on the products releasing their resources.
Sections 7, 12, 13, 14 and 16 survive termination.
12. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error-free, or that data will not be lost.
13. Limitation of liability
To the fullest extent permitted by law, neither party is liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill or data, arising out of or relating to these Terms or the Service, whether in contract, tort (including negligence), statute or any other theory, and whether or not we have been advised of the possibility.
Tonbo’s total aggregate liability for all claims arising out of or relating to these Terms or the Service is limited to the greater of: (a) the amount you paid Tonbo for the Service in the six (6) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
These limitations are essential to these Terms, and we would not offer the Service without them. They apply even if a limited remedy fails of its essential purpose. Nothing in this section limits liability that cannot be limited by law.
14. Indemnification
You will defend and indemnify us against third-party claims arising from your Customer Content, or from your breach of these Terms.
15. Changes to these Terms
We may change these Terms. Where a change is material, it takes effect 30 days after we notify you, by email or in the Service. Continuing to use the Service after that constitutes acceptance. If you do not accept, close your account before the change takes effect.
16. Governing law and disputes
Unless prohibited by the law of your country, these Terms and any dispute between you and Tonbo are governed by the laws of the State of Delaware, excluding its conflict of law rules. You and Tonbo submit to the exclusive jurisdiction of the state and federal courts located in Delaware.
17. General
These Terms are the entire agreement between you and Tonbo regarding the Service. If a provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger or sale of assets.
